1. Acceptance of Terms
These Terms of Use ("Terms") govern the relationship between PeddalDrop, a sole proprietorship business trading as PeddalDrop ("PeddalDrop", "we", "our" or "us"), and every individual or business accessing or using the PeddalDrop platform — including our website (www.PeddalDrop.com), mobile application, or any related services (the "User", "Customer", or "Merchant Partner", "you" or "your").
By accessing or using the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
2. Definitions
- "PeddalDrop" means the sole proprietorship business trading as PeddalDrop, and its authorised representatives.
- "Platform" means the website, mobile application, and related digital services operated by PeddalDrop.
- "Customer" means any individual placing a delivery order through the Platform.
- "Merchant Partner" means a business (kirana store, pharmacy, restaurant, or other local business) using the Platform to dispatch deliveries.
- "PeddalRider" means a trained delivery partner engaged by PeddalDrop on a cycle/e cycle based last-mile delivery assignment.
- "Delivery" means the pickup and drop service performed by a PeddalRider as assigned through the Platform.
3. Services Provided
PeddalDrop provides a technology-enabled platform facilitating cycle & e cycle-only last-mile delivery service within designated pilot zones in Pune, Maharashtra (Services are subject to zone availability, rider availability, and applicable operating hours).
PeddalDrop reserves the right to modify, suspend or discontinue any service, feature or service area at its discretion, with due notice to the users.
4. Prohibited Items
The following items are strictly prohibited from being accepted, tendered, or dispatched via the PeddalDrop Platform:
- Narcotics, controlled substances, or illegal drugs
- Firearms, ammunition, or explosive materials
- Hazardous chemicals, flammable liquids, or radioactive materials
- Alcohol (unless specifically enabled under applicable state excise permissions)
- Cigarettes, e-cigarettes, vapes, electronic nicotine delivery systems (ENDS), and all tobacco products — including nicotine pouches — which are subject to ban and regulatory restriction under applicable Indian law including the Cigarettes and Other Tobacco Products Act (COTPA), 2003, and applicable state-level ENDS bans
- Counterfeit or pirated goods
- Live animals or perishables requiring specialised cold-chain handling
- Currency, negotiable instruments, or bearer documents
- Any item prohibited under applicable Indian law
Merchant Partners or Users shall indemnify PeddalDrop against losses, liabilities or third-party claims arising against PeddalDrop as well as PeddalRiders, due to consignments containing prohibited items, unlawful activities or breach of the Terms by or on behalf of the Merchant Partners or Users.
5. Estimated Delivery Time — Important Disclaimer
Delivery time estimates provided through the Platform are indicative only and are not contractual commitments. Since all deliveries are performed exclusively by non-motorised cycles (PeddalRiders), estimated delivery times may vary from those shown at the time of order placement due to:
- Traffic density, road conditions, and road closures along the delivery route
- Adverse weather conditions including rain, heat, or reduced visibility
- Elevation changes, construction zones, and non-cycle-accessible routes
- Order volume at time of dispatch and rider queue allocation
- Distance variations resulting from optimal route selection
PeddalDrop shall not be liable for delays attributable to any of the above factors. Users are advised to factor in additional time when placing time-sensitive orders. Where delivery timeline is critical, Users should contact PeddalDrop support prior to placing an order.
6. User Obligations
You agree to:
- Provide accurate, current, and complete information when registering and placing orders
- Ensure that the delivery address and contact details are correct and accessible
- Tender only permitted items for delivery
- Treat PeddalRiders with respect and not engage in any harassment, abuse, or discriminatory behaviour
- Not attempt to circumvent the Platform by directly engaging PeddalRiders outside of the Platform
- Comply with all applicable laws in connection with your use of the Platform
7. Payment Terms
All payments for delivery services are to be made through the Platform via authorised payment methods. Prices, delivery fees, and applicable taxes (GST) will be displayed prior to order confirmation. PeddalDrop reserves the right to revise its fee structure with reasonable notice. Merchant Partners are subject to the fee schedule and payment terms set out in their respective Merchant Partner Agreement.
Payments processed through third-party payment gateways are subject to the terms and conditions of the relevant payment service provider.
8. Cancellation & Refund Policy
Orders may be cancelled prior to assignment to a PeddalRider. Once a PeddalRider has been assigned, cancellations may be subject to a cancellation fee. Refunds, where applicable, will be processed to the original payment method within 5–7 business days. Disputes regarding delivery or refunds must be raised within 24 hours of the expected delivery window.
Charges payable to third party payment gateways for the orders that are cancelled shall not be part of the refund.
9. Liability Limitation
9.1 Cap on Liability
Notwithstanding any other provision of these Terms, PeddalDrop's total aggregate liability to any User or Merchant Partner — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — arising out of or in connection with any single delivery transaction shall not exceed the delivery fee actually paid by the User or Merchant Partner for that specific delivery transaction. This cap applies regardless of the legal basis for the claim and whether or not PeddalDrop has been advised of the possibility of such loss.
9.2 Exclusion of Consequential Damages
To the maximum extent permitted by applicable law, PeddalDrop shall not be liable for any:
- Loss of profits, revenue, or business
- Loss of data or information
- Indirect, incidental, special, or consequential damages
- Loss arising from delay in delivery beyond estimated timeframes (see Section 5)
- Loss or damage to delivered goods attributable to the nature of the consignment or inadequate packaging by the User
This exclusion applies whether or not such losses were foreseeable or PeddalDrop had been informed of their possibility.
9.3 Nature of Liability
PeddalDrop operates as a sole proprietorship. All rights, obligations, and liabilities under these Terms are limited to the contracted scope of delivery services as described herein. These Terms do not create any joint venture, partnership, employment relationship, or agency between PeddalDrop and any User. Nothing in these Terms shall be construed to impose unlimited personal liability on the proprietor beyond what is expressly stated in applicable mandatory law.
10. Intellectual Property
All content, trademarks, logos, software, and technology on the Platform — including PeddalDrop's proprietary carbon quantification, routing, and rider welfare systems — are owned by or licensed to PeddalDrop. You may not reproduce, distribute, or create derivative works without prior written consent.
11. Green Delivery Certificate
Merchant Partners subscribed to eligible service tiers may receive PeddalDrop Green Delivery Certificates (GDCs) reflecting CO₂ savings attributable to cycle-based deliveries. GDCs are issued for reporting and marketing purposes only and do not constitute tradeable carbon credits under any statutory scheme unless separately authorised.
12. Termination
PeddalDrop reserves the right to suspend or terminate access of any user to the Platform at any time for violation of these Terms, non-payment, tender of prohibited items, or any activity that poses a risk to PeddalDrop, PeddalRiders, or third parties. Users may deactivate their accounts by contacting support.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Pune, Maharashtra. The language of arbitration shall be English/Marathi.
14. Amendments
PeddalDrop reserves the right to modify these Terms at any time. Revised Terms will be posted on the Platform with an updated Effective Date. Continued use of the Platform after the Effective Date constitutes acceptance of the revised Terms.
